1 BlackBerry Internet Service Requirements: The BlackBerry Internet Service does not integrate with all email accounts or mobile devices.Supported BlackBerry enabled devices include devices with BlackBerry® Built-In™ software (BlackBerry Device Software version 3.8 or later) or devices with BlackBerry® Connect™ software (BlackBerry Device Software version 2.0 or later).
Supported email accounts include POP3/ISP, IMAP4, AOL® Mail, Google Mail™, Windows Live™, Hotmail®, Yahoo!® (POP3 or by proprietary Yahoo! integration protocol), Microsoft® Exchange (using Microsoft® Outlook® Web Access).
Note: Depending on the email service provider, subscribers might be required to subscribe to a premium email account to set up their email account with the BlackBerry Internet Service. Please ensure you check with your Internet Service Provider to confirm whether the BlackBerry Internet Service may be used with that ISP’s service and whether any limitations or restrictions apply.
2 Included Call & Text Allowance: Your monthly spend on included calls and SMS is capped at the plan’s applicable Minimum Spend amount providing you do not spend over the Minimum Spend for your cap plan. For example, on the BIS Cap 79 plan, your monthly spend on included calls and SMS is capped at $79 for up to $340 value.
Call & Text Allowance includes use for National Calls, National SMS, International SMS, National MMS, Voicemail Deposits and Retrievals, 124YES(937), 13 & 1300 numbers, 1800 Toll Free numbers, and SurePage. Use in excess of the Included Call & Text Allowance is charged at the applicable rate. Any unused portion of the Allowance expires at the end of each month and is not refundable or transferable.
Excludes use for International Calls, International Roaming and Diversion, calls to MobileSat, Premium SMS, Optus Zoo Downloads, Horizon Content, Content pack subscription fees, Mobile Internet Usage, 966 Zoo, Directory Assistance, VOIP services and usage, Premium Video, Operator Assistance, Premium Services (e.g. 19XX), and anything else not specified in the Call & Text Allowance inclusions. Usage not eligible for the Included Call & Text Allowance is charged at the applicable rate.
3 Included BlackBerry Internet Service Browsing/BlackBerry Internet Service Email: Unlimited usage includes Internet browsing and email when using the BlackBerry Internet Browser and/or BlackBerry Browser on the handset, via BlackBerry® APN settings only.
Additional charges apply for some services such as video streaming and single file downloads. Mobile Data usage via APNs other than BlackBerry® APN settings will also incur additional usage costs. Refer to “10. Mobile Data” for further details on applicable charges.
4 National Calls: Direct dialled voice calls from Primus mobiles connected on the Optus GSM network to a fixed line service provided in Australia or to a mobile service connected to an Australian mobile network (excluding calls to fixed lines or mobiles provided overseas, calls to 18x and Premium Services, calls to satellite phones and such other call types as Primus from time to time specifies). National Calls are billed in 30-second blocks.
5 SMS: National SMS are text messages to mobile and landline services within Australia. International SMS are text messages to mobile and landlines services provided outside Australia (excluding messages to and from Premium Services and such other service types as Primus from time to time specifies).
The fixed charge applies to up to 160 characters per message per recipient. Additional text will be charged at the same rate. SMS is charged upon origination of a message, regardless of whether delivery is successful or not.
6 International Calls: Direct dialled voice calls from Primus mobiles connected on the Optus GSM network and located in Australia, to a place outside Australia or to a mobile service provided outside Australia (excluding calls to Premium Services and such other call types as Primus from time to time specifies). International Calls are billed in 30-second blocks.
7 Service Provider Charges: Network carriers and the providers of the services may impose charges.
8 Premium Services: Content or live advice services which can be accessed via a phone call, messaging service (e.g. SMS/MMS) or mobile data connection (e.g. Mobile Data). Premium Services numbers usually start with a 188x, 19x, 190x prefix or an international access code. Examples of Premium Services include adult services, psychic lines, weather services, voting lines for TV shows, competition lines and high school test result hotlines.
Proprietary network services, such as Optus Zoo, also offer data Premium Services. Examples include news updates, sports and weather reports, ringtones and wallpaper.
Please contact our Mobile Servicing Team on 1300 85 85 85 to discuss barring these services.
9 Push To Talk (PTT): Daily charges apply once a broadcast has been initiated via PTT. Standard National SMS charges apply when you first register to use PTT. Primus reserves the right to set limits on the use of PTT. We currently consider that the use of PTT for more than 150 broadcast minutes, per month, per mobile service is excessive; we may change this. If you are an excessive user of PTT we may suspend or cancel your access, without prior warning or substitute prevailing plan rates and recalculate charges based on 30-second blocks of usage. To use PTT you must have a PTT compatible handset with the PTT service activated with Primus.
10 Mobile Data: Mobile Data usage includes access to email, WAP services (e.g. Optus Zoo) and Internet browsing directly from your mobile device or by using the mobile device as a tethered modem (via infrared, Bluetooth or cable).
When overseas, International Data Roaming usage charges apply as additional charges. Some data cards/devices are incompatible with networks in some countries. Please contact Primus for information on applicable charges and a list of countries Primus supports.
Any content downloaded from the Internet or WAP enabled websites, such as ringtones or logos, may incur additional charges from the provider of the content (which will be rebilled to you by Primus and payment of which is your responsibility).
Mobile Data transfer speeds may vary depending on the type of device, location and number of users accessing the network at any given time.
Mobile Data usage is charged at the rate of $0.60 per Megabyte (billed in Kilobyte increments) and includes both uploads and downloads. 1024KB = 1MB. 1000MB = 1GB. Mobile Data charges do not apply to BlackBerry Internet Service Browsing/Email usage via BlackBerry® APN settings.
International Roaming: Primus reserves the right to refuse the activation of International Roaming on any Primus mobile service which means you may not be able to use your mobile service to make or receive calls while you are out of Australia.
Handsets & Minimum Term Costs: Only customers with an active Primus mobile service may purchase mobile equipment from Primus. The availability of specific make/model handsets on particular plans is at the discretion of Primus. If a handset has been purchased on a Handset Payment Plan, it is on the condition that you enter into a contract of a minimum period of 24 months (or other agreed period) and that 24 (or other agreed number) monthly handset payments are debited from your credit card as automatic Direct Debit payments each month. If the automatic processing of a Direct Debit payment fails in any month, a Late Payment fee will apply.
If a handset or other equipment has been purchased for $0 upfront or other subsidised amount, it is on the condition that a mobile plan is purchased for a contract period of 24 months or other minimum period agreed.
The minimum total cost over the minimum contract period, is the BIS Cap plan’s monthly Minimum Spend multiplied by the number of months in the contract period e.g. ‘BIS Cap 79’ plan on a 24 month contract is $79 x 24 = $1896, plus any agreed upfront handset price or ongoing monthly handset payments over a contracted period, plus the cost of any other optional services you select (e.g. Mobile Insurance).
If during the minimum contract period the mobile service is cancelled for non-payment or other default, disconnected upon customer request (if we so agree), or churned to another carrier, we will charge you $55, plus the unpaid balance of the retail cost of the handset and any other equipment included in the offer.
Handsets and other equipment sold to you by Primus will be subject to the benefit of manufacturers’ warranties and to warranties compulsorily implied by law.
Plan Changes: During the minimum contract period, you can change from one BIS Cap plan to another with a higher monthly Minimum Spend, without incurring a plan change fee. You can later change that mobile service back to the original BIS Cap plan without incurring a plan change fee. During a minimum contract period, you cannot change from one BIS Cap plan to another with a lower monthly Minimum Spend. Mobile services with no minimum contract period may move to any other mobile plan provided eligibility criteria of the new plan are satisfied.
If a plan is changed mid billing cycle, charges will be adjusted on a pro-rata basis, with the new monthly Minimum Spend charged one month in advance. Please note: included plan allowances will also be adjusted on a pro-rata basis. Therefore, if usage (that is eligible for included allowance credits) exceeds the adjusted pro-rata allowance, excess usage charges will apply.
Change of Ownership: If you apply to us to transfer your contract to another person, we will normally consent providing that you are not in default and that the transferee is approved by us and that you each sign such documents, as we require.
Direct Debit: A $2.50 administration fee applies to accounts not paid by direct debit.
General: BIS Cap plans are available to new mobile service connections only. To connect to these plans you must pass a Primus credit assessment and your application must be accepted by Primus.
Primus reserves the right to withdraw or change any BIS Cap plan or associated promotion at any time. Without limit, we may withdraw it from any user whom we reasonably believe is using it in a manner which we regard as unreasonable or excessive.
Maximum of 3 mobile services per customer.
Access to Optus 3G or HSDPA network service is only available with a 3G/HSDPA compatible handset and Primus 3G/HSDPA SIM card, when the user is in an Optus 3G or HSDPA coverage area (see Primus website for coverage maps: www.iprimus.com.au). Speeds vary depending on the type of device, location and number of users accessing the network at any given time.
All prices quoted, including ‘Included Call and Text Allowance’, are inclusive of GST and may vary on your account as some charges are rounded to the nearest cent before GST is applied.
Primus’ Standard Form of Agreement (SFOA) applies. All prices and other terms and conditions are subject to change in accordance with our Standard Form of Agreement.
